Fucci Inc. (“Fucci,” “the Artist,” “we,” “us,” or “our”) operates a platform for the sale of limited-edition artworks, studio releases, and collectible goods (the “Products”) through https://fucci.ca (the “Website”). By accessing the Website or placing an order, the purchasing party (“Buyer”) agrees to be bound by these Terms & Conditions. These Terms govern all Website interactions and transactions, and any conflicting Buyer terms are expressly rejected unless approved by the Artist in writing. Fucci’s work is produced in controlled quantities and in a manner that prioritizes artistic intent, collector experience, and the integrity of release cycles.

By using the Website, browsing Products, creating an account, or placing an order, the Buyer confirms acceptance of these Terms. Fucci Inc. may revise these Terms at any time, and the version in effect at the time of purchase applies to that order. The Buyer represents that they are of legal age in their jurisdiction and capable of entering binding agreements. These Terms form the exclusive agreement between the parties.

Fucci’s Products include original artworks, limited-edition items, studio-made pieces, and collectible goods. Quantities are often minimal and may not be restocked. Due to the nature of artistic production, print processes, screen calibration differences, and inherent material qualities, variations may occur in color, tone, texture, surface finish, dimension, or aging over time. These variations are considered intrinsic to the art object and are not regarded as defects. All Products are final sale. The Buyer is responsible for reviewing order details carefully before checkout, as modifications or cancellations may not be accommodated once production begins.

All prices displayed on the Website are listed in USD unless otherwise noted. Prices may change at any time. Taxes, duties, import charges, brokerage fees, VAT, and any government-imposed assessments are the sole responsibility of the Buyer. Fucci Inc. reserves the right to correct pricing inconsistencies, including after an order has been placed; if a correction is required, the order may be canceled and refunded. Product descriptions, measurements, availability, and images on the Website are presented as accurately as possible but may contain errors or omissions. Fucci Inc. reserves the right to correct any inaccuracies at any time without obligation.

Orders are shipped via carriers such as USPS, Canada Post, DHL, UPS, FedEx, or others at the Artist’s discretion. Delivery timeframes are estimates and not guarantees, and may be affected by customs inspection, carrier backlog, or external conditions. Risk of loss, theft, damage, or misdelivery transfers to the Buyer unless the Buyer selects an insured shipping method during checkout. Claims for insured shipments must be submitted with supporting documentation and may require investigation by a carrier or insurer before resolution.

Packages returned due to incorrect addresses, failure to collect, or refusal to pay duties or customs fees require payment of a re-shipping fee. If the fee is not paid within 14 days, the order is deemed abandoned and is not eligible for refund. Duties, VAT, and customs assessments cannot be refunded by the Artist and must be handled directly with the Buyer’s local authorities.

Products sold under “Fucci Studios” are produced and fulfilled by our international manufacturing partner and may be shipped separately from core Fucci items. These Products may require extended delivery windows of up to three weeks. All Fucci Studios items are final sale. Buyers are responsible for import duties, taxes, and border charges.

Fucci Inc. retains the right to modify, postpone, or cancel limited-edition releases, pre-order timelines, or made-to-order production schedules due to production issues, supplier delays, material shortages, technical errors, or circumstances beyond the Artist’s control. In such cases, the Buyer will be notified and refunded if applicable.

Fucci Inc. is not liable for failures or delays caused by events beyond its control, including natural disasters, pandemics, governmental actions, supply chain disruptions, labor shortages, transportation failures, or any circumstance legally defined as force majeure. In such cases, performance obligations may be paused without liability.

Fucci Inc. may offer refunds or replacements at its discretion. Damage claims for insured shipments require photographic evidence, documentation, and, when relevant, carrier or insurer confirmation. Refund requests will not be considered more than 48 hours after delivery. Refunds for customs duties, VAT, or border fees are not issued by the Artist.

Fucci Inc. may cancel orders due to stock discrepancies, payment issues, security concerns, policy violations, fraud indicators, or automated checkout activity. Bot usage, automated purchasing tools, checkout manipulation, or circumvention of purchase limits are strictly prohibited. Transactions flagged as automated or suspicious may be canceled and may incur a 15% restocking fee. Fucci Inc. may block devices, accounts, or IP addresses engaged in abusive or fraudulent behavior.

Order confirmation acknowledges receipt but does not constitute acceptance. A contract is formed only upon dispatch. If an order cannot be fulfilled within two weeks, the Buyer will be notified and refunded. Refund processing typically requires three to seven business days depending on the payment provider. By submitting payment, the Buyer confirms authorization to use the selected payment method. Fraudulent or unauthorized transactions may be investigated and reported to financial institutions or law enforcement.

Products are provided “as is” except where legally required otherwise. Fucci Inc.’s liability is limited to the purchase price of the Product. The Artist is not responsible for technical failures, Website interruptions, external link content, carrier delays, or damages resulting from Website use. The Buyer assumes all risks associated with Website access.

All artwork, text, images, graphics, product concepts, designs, audiovisual material, website layout, and underlying code (“Content”) are the exclusive property of Fucci Inc. No Content may be reproduced, mirrored, retransmitted, adapted, commercialized, tokenized, minted as NFTs, captured for resale, or used for derivative works without written permission. Unauthorized use may result in legal action, including damages and injunctive relief.

By placing an order, the Buyer consents to the collection and use of personal information required for authentication, fraud prevention, payment processing, shipping coordination, and customer support. Information may be shared with service partners only as necessary. The Buyer consents to receiving transactional communications, including order confirmations, updates, and notifications. All matters relating to Website use or purchases are governed exclusively by the laws of Canada. Any claim must be filed within one year of the event giving rise to the claim.

The parties will attempt good-faith resolution for 30 days before pursuing mediation in Canada, followed by litigation if necessary. The prevailing party is entitled to legal fees.

Fucci Inc. may restrict or terminate Website access without notice for policy violations, abusive conduct, fraudulent behavior, bot activity, system exploitation, or suspicious activity. Devices, accounts, or IP addresses may be blocked.

If any provision of these Terms is deemed unenforceable, the remaining provisions remain in effect.

These Terms constitute the full and exclusive agreement between the Buyer and Fucci Inc. regarding Website use and transactions.
